Court prohibits disclosure of retired teachers' names

ALBANY, N.Y. (AP) - A midlevel appeals court has refused to force the public disclosure of New York's retired teachers.

The Appellate Division in Albany, upholding a lower court Thursday, has rejected the request under the state's Freedom of Information Law for names from the New York State Teachers' Retirement System.

The four justices cite a 1983 ruling from New York's top court that New York Police Department retirees' names and addresses are exempt from public disclosure and a similar ruling in 2011 from another midlevel court concerning just names.

The Empire Center for New York State Policy says it wants names but not addresses and will try to take this case to the top Court of Appeals.

The center publishes public pensions on its website, saying teacher names were disclosed previously.
