With Some Reservations, Reed Okay With Red Flag Law

ITHACA, NY (WSKG) - New York’s red flag law went into effect on Saturday. 23rd District Congressman Tom Reed said he considers such laws reasonable. The Republican also expressed concern that due process be maintained. 

"What we have to make sure, in this discussion is that law-abiding citizens rights are protected," Reed, a Republican, said.

The red flag law allows a judge to order guns confiscated if a statement is signed by law enforcement, school officials or family members saying the person is a threat to themselves or someone else.

The person is unable to get a gun permit while the order is in place and a hearing is conducted. If a judge considers the threat credible the order could last up to a year.

Reed said there should be serious penalties for people making frivolous or retaliatory accusations.

He also said he is always looking at what existing laws can do that do not cause redundancy. In this case, he said there are existing laws that are effective at stopping mass shootings.

"Because law enforcement is now enforcing the ‘credible threat’ provisions that when they pick up something on social media," he said. "They’re not taking any chances."

Reed was previously mayor of Corning. He now represents parts of the Southern Tier and Finger Lakes in Congress.
