Frustration With 7-Year-Old Entrepreneur For Lacking Lemonade Stand Permit Prompts Action In Albany

VESTAL, NY (WSKG) -- Last July, a state health inspector shut down 7-year-old Brendan Mulvaney’s lemonade stand. Vendors at the county fair nearby were complaining. They demanded a permit from Brendan. He didn’t have one, so they forced him to close down for business.

Then Governor Cuomo intervened. Stands operated by elementary school kids aren’t typically required to have permits. Cuomo ordered health officials to make sure Brendan’s stand reopened, and apologize.

To put things to right, the New York Senate Health Committee has passed a bill to clarify the law to say kids under 16 don’t have to get the $30 permit. It hasn’t been scheduled for a full vote yet.
